Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and peakbyt regarding your use of e-bot and any related dashboards, APIs, and services. By creating an account or sending traffic through our webhook, you accept these Terms.

1.Acceptance of terms

By accessing or using e-bot, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the service. If you are using e-bot on behalf of a business, you confirm that you have authority to bind that business to these Terms.

2.Eligibility

You must be at least 18 years old to use e-bot. You must operate a legitimate business and have the legal right to sell the products you list. Use of e-bot for personal, non-commercial purposes is not permitted.

3.Account registration and security

You are responsible for keeping your account credentials, API keys, and Facebook Page Access Tokens secure. You must notify us immediately at contact@peakbyt.com of any unauthorized access. You are responsible for all activity that takes place under your account.

4.Description of the service

e-bot is a backend platform that connects your social media pages (currently Facebook Messenger, with Instagram on the roadmap) to an AI assistant. The bot uses your uploaded product catalog, policies, delivery zones, and store information to answer customer questions and place orders on your behalf inside Messenger. Features and behavior may change over time as we improve the product.

5.Acceptable use

You agree not to:

  • Sell illegal, counterfeit, restricted, or dangerous goods.
  • Use e-bot to send spam or unsolicited bulk messages.
  • Impersonate another business or person.
  • Mislead customers about pricing, availability, or delivery.
  • Reverse-engineer, scrape, or attempt to derive the underlying source code or models.
  • Interfere with the service's operation or attempt to gain unauthorized access to other accounts.
  • Upload product images you do not own or have permission to use.
  • Violate the Meta Platform Terms or Messenger Platform Policy.

6.Your responsibilities as a store

  • Keep your product catalog accurate — prices, stock, sizes, and images current.
  • Honor orders that the bot places on your behalf after a customer confirms them in Messenger.
  • Comply with consumer protection laws applicable to your business and to your customers.
  • Respect Facebook's 24-hour messaging window — outside it, use only an approved message_tag.
  • Provide a clear return and exchange policy and honor it as published.
  • Respond promptly to customer complaints that escalate beyond the bot's capabilities.

7.Meta Platform compliance

e-bot operates on top of Meta's Messenger Platform. Your use of e-bot is also subject to:

  • The Meta Platform Terms.
  • The Messenger Platform Policy.
  • The Facebook Community Standards.

If Meta suspends, restricts, or revokes access to your Page, e-bot will be unable to send or receive messages for that Page. You are responsible for maintaining a Page in good standing.

8.Fees and billing

Pricing is communicated separately and may include a subscription fee, a per-message fee, or a pass-through charge for third-party costs (notably OpenAI token usage). You authorize us to charge you for usage you incur. We may revise pricing on 30 days' notice. Failure to pay overdue fees may result in suspension or termination.

9.Intellectual property

peakbyt and its licensors own all rights, title, and interest in the e-bot platform — including the software, models we trained, dashboards, documentation, and trademarks. You receive a limited, non-exclusive, non-transferable license to use e-bot during your subscription.

You own your store's catalog data, your customer conversations, and your orders. You grant us a limited license to process this data only to the extent needed to operate the service for you.

10.Third-party services

e-bot integrates with OpenAI, Meta Platforms, and other third-party providers. Their availability, latency, policies, and pricing are outside our control. Your use of e-bot is also subject to those providers' terms; if their terms conflict with ours about how data flowing through their systems is used, their terms govern that flow.

11.Disclaimers

The service is provided “as is” and “as available”. We make no warranties — express or implied — about merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the service will be uninterrupted or error-free.

Large language models occasionally produce incorrect, incomplete, or misleading replies. You are responsible for reviewing the system prompt, your catalog, and order outputs to make sure they reflect your business correctly. e-bot is a tool, not a substitute for human judgement on edge cases.

12.Limitation of liability

To the maximum extent permitted by law, peakbyt and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, business interruption, or reputational harm — arising out of your use of the service.

Our aggregate liability for any claim related to the service is capped at the amount you paid us for the service in the twelve months immediately preceding the event giving rise to the claim, or USD 100 — whichever is greater.

13.Indemnification

You agree to indemnify, defend, and hold harmless peakbyt and its officers, employees, and affiliates from any claim, demand, or expense (including reasonable legal fees) arising out of: (a) your use of the service, (b) products you sell through the service, (c) your violation of these Terms, or (d) your violation of any third-party right, including Meta's platform policies.

14.Termination

You may terminate your use of e-bot at any time by closing your account. We may suspend or terminate your account immediately if you breach these Terms, fail to pay fees, or if continued service would expose us to legal or platform-policy risk. On termination, your access to the dashboard and API ends; we will retain data only as described in the Privacy Policy.

15.Governing law

These Terms are governed by the laws of the People's Republic of Bangladesh, without regard to conflict-of-law principles.

16.Dispute resolution

The parties will first attempt to resolve any dispute through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to the exclusive jurisdiction of the competent courts of Dhaka, Bangladesh.

17.Changes to these terms

We may revise these Terms from time to time. We will post the updated Terms at this URL and update the “Last updated” date. Material changes will be announced in-product or by email at least 14 days before they take effect. Your continued use of the service after the change date constitutes acceptance.
